Honduran Attorneys File Writ Blocking Security Tax

Representatives of the Honduran Bar of Anti-corruption Attorneys today filed a writ of amparo with the Supreme Court of Justice of Honduras against the proposed "security tax" passed by Congress on December 14, 2011. The tax legislation (Decree 252-2011) has not yet been published in the government's official newspaper, La Gaceta, and thus has not become law. However, the writ can be used not only to block laws but also acts, orders, and actions by the government. It was submitted "in opposition to the act by the National Congress of approving a document that violates constitutional guarantees," said Rafael Padilla, a member of the Bar. According to Mr. Padilla, the decree interferes with the right of Hondurans to enter and leave Honduras at any moment.
In response to the writ, the government's Minister of Communications, Miguel Ángel Bonilla, stated that both President Porfirio Lobo and the Congress are analyzing the decree in order to find a solution that benefits the people of Honduras. "It has not been published. It has not been signed by the President of the Republic. It is not a law," noted Mr. Bonilla. Different sectors of Honduran society have questioned the implementation of the new tax and have urged President Lobo to veto the measure. (1/9/12)
